Our Terms and Conditions

The terms ‘Studio One Frames Ltd’ or ‘our’ ‘us’ or ‘we’ refers to the owner of this website whose registered office is The Old Church Hall, 7 London Road, Little Clacton, Essex, CO16 9RW. All terms and conditions apply to Studio One Frames Ltd and their print studio, dStudio, with both sharing a company registration number of 04758445. The term ‘you’ ‘your’ or ‘users’ refers to the users or viewer of our website.

All services provided by this website may only be used in accordance with the terms and conditions provided below. By using our services you agree to be bound by our terms and conditions.

Studio One Frames reserves the right to make modifications and changes to these terms and conditions at any time and without prior notice. Up to date terms and conditions will always be available at dstudiouk.com

The placing of an order with Studio One Frames creates a contract on the basis of these terms and conditions. These terms and conditions apply equally to all orders given, irrespective of method. It is the responsibility of the user of our services to be aware of our terms and conditions.

Nothing in this agreement will affect any consumer's statutory rights.

We reserve the right to send special offers and newsletters to account holders email addresses, with an instant unsubscribe option available.

Placing an order

The placing of an order online, via email, in person or by phone constitutes acceptance of prices shown on our website and you will be held liable for the full order value.

As all of our prints are made to order, in the event that you wish to cancel or amend an order please contact us within 24 hours. If you fail to do so and work has commenced on your order we will not offer any monetary compensation and you will be held liable for payment in full. Please note this does not apply to Express orders.

Whilst we make every effort to identify obvious errors on order forms all information contained within your order form must be accurate and exact and we will not accept liability for missed or inaccurate information resulting in a final print product, which does not meet your satisfaction. In this instance provided Studio One Frames have executed your order, as per your order form instructions you will be held liable for payment in full.

All sizes quotes are nominal and Studio One Frames shall accept no liability for minor variations in size as a result of inadequate preparation of files. All orders are finished by hand and because of this we allow a tolerance of 2mm in each direction.

Copyright

It is the responsibility of all users to ensure that all materials presented for printing are free from any third party claims for breach of copyright or license and as such Studio One Frames accepts no responsibility for the copyright or licensing issues of files submitted and users indemnify Studio One Frames against any claim.

Images submitted which breach our terms and conditions.

Customers are not permitted to request that Studio One Frames print images containing or relating to the following:

  • Racist material
  • Material that is likely to incite hatred against any person or group
  • Defamatory or otherwise actionable material
  • Material that is libelous in nature
  • Images of any criminal act
  • Material, the use or inclusion of which infringes any copyright, trademark, or other intellectual property right of a third party, or
  • Material which breaches any applicable laws or legislation

We reserve the right at our sole discretion to refuse to execute print orders, which breach our terms and conditions without notice. Where appropriate we may also to contact law enforcement agents or authorities should we receive images which breach any applicable laws and may supply such content to authorities and divulge otherwise private information to the authorities, including details stored within user accounts.

We may also reserve the right to refuse further service pertaining to any person or persons who has knowingly or unknowingly breached any of the terms and conditions of the website.

Uploading files

Digital images may be uploaded to the website, images submitted in formats not specified by our service may not be accepted and this may result in your order being rejected or delayed without written warning.

Whilst users images are stored after printing we accept no liability for their loss and as such you are advised to maintain suitable back-ups of all materials and files.

Colour matching / Proofing

We maintain all printing equipment at optimum specifications and while every effort will be made, exact colour matching cannot be guaranteed. Due to the imprecise nature of colour management some colours may not accurately reproduce. Additionally discrepancies may arise when your finished product is viewed outside of the controlled environment of our studios.

In this instance we cannot be held responsible for differences in tone, contrast, or any other aspect of an image supplied which differs from its appearance on screen. The colour management process is designed to minimize and not eliminate tolerances in the reproduction of colour prints.

It is strongly recommended that customers request a proof before proceeding to print, without which reproduction will be at our discretion. If you have placed an order without using our proofing service your image will be printed as it has been received and should you be dissatisfied with any matters relating to colour management you will still be held liable for payment in full.

Studio One Frames offers a proofing service but does so with the user's acceptance that colour matching and the preparation of files is subjective, and that totally accurate colour matching to 100% fidelity is rarely possible. We will endeavor to achieve the closest possible match within the limitations and constraints of available technologies, materials, and processes used.

When supplying a proof we will wait to receive acceptance of your satisfaction of the print provided. Once you have confirmed you are happy with this and we have proceeded to print no further changes can be made and you will be held liable for payment in full.

Original Artwork

While all care will be taken when handling supplied artworks, works are submitted at your own risk. Studio One Frames accepts no liability for the replacement or consequential loss arising from the damage or loss of supplied artwork. Owing to courier restrictions we are unable to request extended liability when sending original artwork through the postal network and as such it is the sole responsibility of the users to provide independent insurance cover for possible loss or damages incurred in delivery if they wish to do so.

Specified Lead Times

We will make every effort to ensure orders are completed within the stated lead times but cannot accept liability of consequential losses arising should these not be met. Lead times which are quoted are target times only and start only from the point at which we receive all images and order details required to complete your order. Should you make changes to your order, or the images supplied do not meet the required specifications for print; your order may be delayed.

Payment for your order will still be due in full and no monetary compensation will be offered should we fail to meet a quoted delivery time. Studio One Frames reserves the right to amend our lead times during seasonal periods without prior notice.

Prices and Payment

All rates, prices and discounts quoted or published at dstudiouk.com are subject to variation at any time prior to acceptance your order. All prices quoted include VAT. VAT applies to all transactions for goods or services at the current applicable rate at the time of purchase.

All of our orders are “Made to Order” and therefore all goods are sold on a non-cancellation basis once delivered.

Payment is required upon receipt of invoice, and the balance must be paid within 48 hours. Goods remain the property of Studio One Frames until the order is paid in full. If we do not receive payment within a period of 1 calendar month your details will automatically be passed to our debt recovery agents for collection. In doing you may be liable for further costs to include court fees and an appropriate level of compensation as set by our debt recovery partners or a court of law.

It is your responsibility to ensure that all balance payments are made and failure to do so may delay delivery of your order and prevent further orders from being accepted.

For orders over £500, Studio One Frames reserves the right to request payment before commencing the printing of your order or before dispatch and failure to provide this will result in your order being delayed. When required you will be advised of this in writing.

Should there be any uncertainty regarding the credibility of a submitted payment, Studio One Frames reserves the right to suspend the order in question and the offending account may be terminated.

Delivery and Collection

You may collect goods from Studio One Frames or have them delivered. Delivery of completed orders will be made on behalf of Studio One Frames by Royal Mail, our carefully selected courier companies or any other delivery services at the discretion of Studio One Frames.

Charges for postage, packing and delivery will be incurred and payable at the time of order. You shall be responsible for all customs and other duties and all related costs and expenses payable on any international transaction.

Where specified you will be required to sign for delivered work, or we will not be held responsible for any losses arising from the delivery.

Where Studio One Frames has agreed to deliver goods to you, goods shall be delivered to the delivery address specified, if our representatives are unable to gain access to the delivery address or delivery is delayed due to any act or omission of the client, you will be held liable for any additional delivery costs incurred as a result of re arranging delivery.

Immediately upon receipt or collection of any goods, you should inspect and satisfy yourself with its condition. If you fail to inform us within 48 hours after receipt or collection, of any defect or problem you shall be deemed to have confirmed that the goods are in a satisfactory condition upon delivery or collection and payment will be due in full.

Studio One Frames will offer a replacement if an item is deemed ‘lost in the post’. In this instance this will only apply if an exact address has been supplied and no evidence exists to suggest the customer has been left a delivery card or contacted by our courier services in relation to the delivery. Such a replacement will only be offered when the appropriate delivery time as stated on our website has expired.

Studio One Frames maximum liability shall not exceed the total sum payable in connection with the relevant order. We shall not be liable for any loss of income or profits, loss of contracts or for any indirect or consequential loss or damage of any kind howsoever arising.

Returns Policy and Damage

In the event that your print is damaged in any way upon receipt, please contact us as soon as possible. We cannot be held responsible for any damage to, discrepancies in or shortages of delivered materials unless notified within 48 hours of receipt.

Any claims for damages must be supported by photographic evidence and we reserve the right and may request the return of the damaged article, which we will arrange the collection of. Claims of this nature will be limited to the cost of the order as charged by Studio One Frames. No actions will be taken by Studio One Frames without photographic proof or the receipt of the damaged item.

Any items returned to Studio One Frames will be destroyed after investigation.

If you are eligible for a refund, we will reimburse the price you have paid for the goods by means of your original payment method. Alternatively we may offer to reprint and resend the item free of charge. Please note in this instance replacements will be sent using Royal Mail First Class delivery or our courier where appropriate.

Please note it is not our policy to offer both a refund and a reprint.
